Membership
By joining Galova Limited (trading as Gym Plus Cork); Mandabe Limited (trading as Gym Plus Naas); Prime Fitness Limited (trading as Gym Plus Ashbourne, Rathfarnham and Swords); Prime Fitness (Ballsbridge) Limited (trading as Gym Plus Ballsbridge); or Prime Fitness (Drogheda) Limited (trading as Gym Plus Drogheda) collectively the Gym Plus Group (“Gym Plus”, “we” or “us”), the member agrees to comply with these Terms and Conditions of membership (“Terms and Conditions”) and the Club rules. You will only be permitted to use the facilities at whichever of the Gym Plus clubs you have joined as a member of (the “Club”) within the scope of your membership category. These Terms and Conditions apply to your membership and use of the Club. The Club reserves the right to reject any application for membership for any reason in its sole discretion. No reason need be given by the Club for such rejection.
Duration:
When you join Gym Plus, you are agreeing to remain a member for a period of 3 calendar months (“the Commitment Period”), subject to extension if placed on freeze. Monthly memberships will continue to renew automatically after the Commitment Period end date. If you choose to join the Club by paying your Commitment Period membership fee in advance, your Club membership will terminate automatically on the expiry of the Commitment Period. An email informing you when your membership is due for renewal will be sent to all 12-month upfront members 1 month prior to the date that the membership is due for renewal. This email will include details regarding the cost of renewal and the renewal date.
Fees and charges:
The Club will set the level of fees and reserves the right to change the level of fees from time to time at its sole discretion. The following fees prevail:
a) Membership Fee: The level of membership fees shall be determined according to the type and
category of membership.
b) Joining Fee: A joining fee is payable as specified in your membership form.
c) Guest User Fees: A guest user fee is payable as a one-off fee for a guest to use the Club and its facilities on one occasion.
If you sign up for a membership online and change your mind, there is a cooling off period of 14 days from your join date by which to cancel your membership. If you no longer wish to stay a member and have not used the Club, you may cancel your membership with immediate effect by emailing membership@gymplus.ie and your payment will be refunded. If you have used the Club, we reserve the right to charge you a reasonable fee for your gym usage during this period. In all other instances, Membership Fees, Joining Fees, and Guest User Fees are not refundable.
We will inform you if your bank fails to make a payment from your account. You may settle the balance at the Club’s reception, or online through the Gym Plus app, or on the client portal. If the debt remains outstanding, we will apply to your bank for payment again throughout the month at various intervals. If this is not paid your debt will remain on the Gym Plus system. As a result of this, you will be unable to use or re-join Gym Plus without settling this debt.
If you choose to pay your membership fees monthly, we only offer debit or credit card recurring payments. You can amend your card details 72 hours in advance on the Gym Plus app or the client portal link. It is your responsibility to update your account to reflect any changes. We may at any time engage the services of a third-party payment processing agent or platform, such as Stripe, to process payments.
All Club Membership Fees and other fees are reviewed periodically. We will give you at least 1 month’s notice of any changes to fees.
Suspension of Membership:
You may request suspension (freeze) for a continuous period of at least 1 month and a maximum of 3 months upon 15 days written notice to the Club. You understand a monthly charge of €10 will be charged by the Club during the suspension period(s). Any suspension that occurs during the Commitment Period will result in an extension of the Commitment Period for the same amount of time as the suspension was in effect. A member can only freeze their membership for a maximum of three months in any 12 month period. Should you request to cancel your membership while it is on suspension, the suspension will be removed, and your cancellation will be processed in accordance with the Club’s standard 30 days notice period.
Termination:
Termination by the Club:
We may terminate these Terms and Conditions in the following circumstances:
a) if you commit a serious or repeated breach of these Terms and Conditions or the Club’s rules of membership and the breach, if capable of remedy, is not remedied within 7 days of receipt of a default notice;
b) if any part of your membership fee remains unpaid 30 days after its due date for payment; or
c) if you provide us with details which you know to be false when applying for membership and the false declaration would have reasonably affected our decision to grant you membership.
Termination by you:
You may terminate these Terms and Conditions in the following circumstances:
a) You may give written notice at any time during your commitment period to terminate your contract at the end of
your commitment period, provided that the written notice is given at least 30 days in advance of the end of you commitment period. If there are fewer than 30 days remaining before the end of your commitment period, your contract will terminate at the end of the 30 days from the date you provide your written notice.
b) You may terminate a monthly membership by giving the Club at least 30 days written notice so that your membership will terminate at the end of the following calendar month after notice was given. Please send an email to membership@gymplus.ie to start the process.
c) You may also terminate these Terms and Conditions if:
d) We permanently reduce the facilities or opening hours of the Club;
e)Â We change the location of the Club; or
f) We close the Club for refurbishment for a period of more than 30 days at a time.
Cancelling your payment instruction for the payment of fees will not be deemed to be a termination of these Terms and Conditions and you will be liable for outstanding debts to Gym Plus.
Access Control:
To access the Club you must record your visit by scanning your personal QR code which you access through the Gym Plus app. In exceptional circumstances, it may be possible to purchase an access fob which will be charged at a price of €3. Membership is not transferable and any member who allows his/her/their access code to be used by another person is in serious breach of these Membership Terms and Conditions and will entitle the Club to terminate membership without notice. If a membership fob is lost, it should be reported to the Club. The Club reserves the right to charge an administration fee for the provision of a replacement membership fob.
Club Rules:
The Club may amend the Club Rules from time to time in order to ensure the health and safety of members.
Opening Hours:
The Club’s opening hours, as amended from time to time, are displayed at the Club reception.
The Club reserves the right to adjust the opening hours, and availability of certain facilities or close the Club on a temporary basis for the general purpose of cleaning, decorating, essential repairs, maintenance of equipment, special functions and holidays.
Limitation of Liability:
The Club will not accept liability for any loss, damage to or theft of money, valuables or other personal property of members and/or guests. Property stored in lockers provided by the Club is stored at the owner’s risk and no liability for loss or damage thereto will be accepted by the Club. Lockers may be hired for monthly or yearly use for a fee based on the Club’s fees in place from time to time. If a locker is not hired, then it may only be used on a daily basis and must be emptied by the user before leaving the Club.
The Club accepts liability for damage, accident, death, personal injury or other loss sustained by members and/or guests on the Club premises that is reported to the Club immediately or as soon as is reasonably practical to the extent caused by the Club’s negligence or the negligence of its employees and agents (during the course of their employment and agency, as appropriate) unless that failure is attributable to:
a) Your own fault;
b) A third party unconnected with our provision of services under these Terms and Conditions; or
c) Events which neither we nor our supplier could have foreseen or forestalled even if we had taken all reasonable care.
The exclusions and limitations of liability set out in these Terms and Conditions shall apply to the maximum extent permitted by applicable law and will not affect your statutory rights as a consumer.
Health & Safety:
Members must read all Health and Safety notices displayed in the Club and comply with their recommendations. The member acknowledges that they are in good health and are not suffering from any illness or disease. Members exercise at their own risk. We advise that all members check with a medical professional in advance of starting a new exercise routine or regime. The facility health screening questionnaire must be completed in advance of using the facility.
We request that members ask Club staff for assistance if they are unsure about how to use any piece of equipment. Our staff are happy to assist and we recommend that you request a run-through of how to use the equipment at the beginning of the membership period.
Sale of Club:
In the event of the sale or disposal of the Club to another company or to any other person we may transfer your membership to the new owner and you will continue as a member of the Club and continue to pay your membership fees provided no changes to these terms or the Club rules having a material adverse effect on your use of the Club are made by the new owner. Any such disposal will not affect your contractual or statutory rights.
CCTV:
We have closed circuit television located at specific locations within the Club. This is necessary in order to protect against theft or pilferage and for the security of members and employees.
Mobile phones, cameras and recording equipment:
Mobile phones are prohibited for use in changing rooms, spas, and swimming pool areas. Please respect other members’ right to privacy and to work out without being recorded or photographed. You are not permitted to take photos or record videos that contain the personal data of others.
Data Protection:
Please refer to our privacy policy available at www.gymplus.ie or in the Club.
Data Protection:
We may amend these Terms and Conditions from time to time and we reserve the right to update or alter these Terms and Conditions at any time. Any amendment will take effect and be deemed to have been accepted by you 7 days after being posted to our website, immediately upon notice to you in writing by email or upon your continued use of our services after having been notified in-Club and/or by email of the amendment. We recommend that you familiarise yourself with the most up-to-date version available.
